Can a aircraft opt not to attack during his airstrike phase and move off the board? seems logical to me if he dives down to shoot a pak 40 and sees some anti aircraft in the distance he decides to turn around.

Once an aircraft is placed on the board, it's stuck there until the end of the turn. Because of the sequencing of the turn, you can see all the antiaircraft potential before you place your plane. If you find that the situation is too hot for your plane ... well, that's your fault for putting it there in the first place.

What you can't see is the 2nd persons placement of his aircraft. So if you drop your stuka behind enemy lines, and the allie player drops his p-51 next to the stuka. what your telling me is that when its the stukas players turn, he has to leave the stuka there, and take a shot at something rather than run away from the p-51?

~but a tank that moves into enemy territory first can move during his assult phase instead of attacking seeing that the enemy rolled in another tank to take a good shot at him? doesn't make sense to me

I understand your confusion but planes have no real movement, they are just placed on the map to represent that 'snapshot' when they are attacking the target. The fact that your opponent has a Mustang will be known to you at the beginning of the game so there should be no surprises. In this case, the element of moving second has an advantage, rather than moving first. That is intentional.
