Set the scene:
Set 1 minis released it contains an R35 in romanian markings
( I'm a self confessed expert on ww2 romanians, an extra tank to use for romanians)
39-45 maxis r35 cross missing but still in romanian tank markings
Therefore can i keep the romanian bonus points for an all romanian army if i use the R35 or the Platoon? ala panzer IV
(Historically correct but under the rules incorrect).

The R-35s in sets 1 and 6 are both French, according to their stat cards. This makes them Allies tanks and unusable in any Axis army, unless you're playing with a home rule. You couldn't use R-35s in any Romanian army unless your opponent agreed to allow that. In a tournament, you'd need to get special permission from the judge.

In friendly games, however, I'd certainly allow it, since Romania built R-35s in its own factories.

Romania is an allied nation from august 1944 till end of war they had the fourth largest allied army in europe at end of war after Russia USA and GB. so therefore can it used allied cards?

Sorry, the answer is still no. The rules list Romania as an Axis country, and there's no rule that covers switching sides. As stated, there's no reason you couldn't do this in a casual game, but in a tournament, you'd need special permission from the judge.
